Mediation Services

Mediation Services

Mediation is a confidential dispute resolution process overseen by a neutral third party – a mediator. Mediation is a non-binding process. What does that mean? It means that the parties involved don’t have to accept a proposed solution: they can voluntarily agree to it, or not. The mediator doesn’t give legal advice, is not playing the role of a judge, and does not make any decisions regarding the dispute. The role of the mediator is purely to facilitate a discussion and help the parties find a solution that both can agree on.

However, while the process itself is non-binding, if and when the parties involved do come to a settlement agreement, the terms of the settlement are legally binding. If they can’t find a solution, they still have the option to move forward with arbitration or if necessary, litigation.

Stickland ADR can help the parties with their understanding of the law, how the Court may apply it given their issues, and focus the parties on the good and the bad of their cases. We can provide mediation services at in-person proceedings or via Zoom, whatever the interested parties prefer.

Arbitration Services

Unlike mediation, arbitration is a binding process. It’s similar to a trial in court because the process involves the presentation of evidence and legal arguments.

However, the major difference is this: the court systems have a single judge presiding over a dispute, or the presence of a jury who renders a decision. Arbitrations have a single arbitrator or an arbitration panel (typically three arbitrators) who hear the evidence and legal arguments, and then decide the outcome.

Once the process is complete, the parties are legally bound to accept the arbitration decision and comply with it. Christopher Stickland can serve as a panel arbitrator or a single arbitrator.
